This User Agreement sets forth binding terms and conditions that govern all access behaviors and usage activities related to the Facey application. This agreement clarifies the rights and obligations of all users during the use of this lightweight local AI avatar generation tool, regulates the permitted use scope of application functions, virtual currency rules and other important usage clauses. Before downloading, installing and using Facey, every user shall carefully read and fully understand all contents of this agreement. The normal use of any function of Facey will be regarded as unconditional acceptance of all clauses involved in this User Agreement.
All data processing operations of Facey are completed inside users’ local devices exclusively. All uploaded photos, generated avatar images, animated GIF files and related operation records are only stored within the user’s personal local device. Once users actively delete relevant content through the built-in deletion function of Facey or clear local cache files, the corresponding data will be permanently erased from the local device. Under any operational scenarios, Facey will never obtain, process or store any facial data and facial feature information belonging to users.
1. General Terms
1.1 Agreement Definition
Facey refers to a lightweight local AI portrait avatar generation application that focuses on creating exquisite social profile pictures for users. This User Agreement applies to all software versions of Facey adapted for mobile terminal devices, as well as all derivative functions and updated modules launched in the later stage. In this agreement, users refer to all natural persons who independently download, install and use the application on compatible mobile devices, and Facey always executes all AI computing tasks locally without collecting any user facial data or other sensitive private information.
1.2 Account Usage Rules
Facey implements a completely account-free usage mechanism for all users. Users are not required to complete registration, login, mobile number binding, email verification and other identity authentication operations to access all core functions including local AI static avatar generation, animated GIF creation and local file export. There is no user identity database built inside the application. The account-free design simplifies user operation steps and fundamentally avoids potential risks of private information leakage, and this operating mode ensures that Facey has no channel to collect, obtain or store user facial data and other personal information in any situation.
1.3 Agreement Revision Right
The operating team of Facey reserves the independent right to revise, supplement and optimize the clauses of this User Agreement according to product function iteration, usage scenario adjustment and other objective demands. Once the agreement content is updated, the latest version will be released in the dedicated announcement area inside the local application. The revised clauses will take effect immediately after publication. Users who continue to use Facey after the update are deemed to accept the adjusted agreement content. The revision of this agreement will never involve any behavior of collecting user facial data, and the zero-collection principle of facial information will remain unchanged permanently.
2. User Usage Rights And Restrictions
2.1 Authorized Usage Scope
After installing Facey, users obtain a limited, non-transferable, non-commercial exclusive usage right for this application. Users can utilize the built-in local AI algorithm to upload single portrait photos, generate styled static avatars and dynamic GIF avatars, adjust style strength and detail parameters independently, save finished works to local albums and complete local offline sharing operations. All usage behaviors are limited to personal daily social use only, and all avatar generation processes run independently on the user’s local device, and Facey does not collect any facial data generated during user operation.
2.2 User Behavior Specifications
All users shall abide by this User Agreement and relevant usage norms when using Facey. Users are prohibited from using this application to generate offensive, vulgar, discriminatory and other inappropriate content, and forbidden to apply the avatars and dynamic works generated by local AI to illegal, improper or commercial profit-making scenarios. Users shall bear all legal responsibilities arising from their improper operation behaviors independently, and Facey does not participate in user content creation, and will not collect facial data and created content for any supervision or management purpose.
2.3 Usage Restriction Measures
If users violate the clauses of this User Agreement and engage in prohibited behaviors specified in the above chapters, the Facey team has the right to restrict partial functional permissions of the application for the corresponding user, including but not limited to suspending the local AI generation function and clearing invalid local consumption records. All restriction operations only act on the local application authority of the user’s device, and the implementation of restriction measures will not involve the collection of user facial data and any other private sensitive information.
3. Local AI Generation Service Rules
3.1 Service Content Explanation
Facey provides two core local AI generation services for users. The first one is static avatar generation, which supports multiple styles covering Japanese series, Korean series and hand-drawn illustration series, and allows users to fine-tune detailed parameters. The second one is dynamic avatar production, which generates subtle looped animation effects based on users’ original portrait pictures. All algorithm calculations and content rendering work are completed by the local AI framework inside the user’s mobile device, and no picture data or facial feature information will be transmitted to the outside of the device throughout the service process, and Facey never collects user facial data.
3.2 Content Ownership Confirmation
All static avatars and animated GIF works generated by users through Facey’s local AI functions are fully owned by the corresponding users. Users have the right to independently save, delete, export and share their created works. Facey does not obtain any ownership, usage right or authorization right of user created content. Meanwhile, users shall be solely responsible for all uploaded original portrait photos, and all uploaded photos and generated works are stored only in the user’s local device, and Facey has no right to obtain or collect these materials and contained facial data.
4. Virtual Currency And In-App Purchase Rules
4.1 Dual Wallet Mechanism
Facey adopts a dual-wallet virtual currency system including permanent coins and subscription coins to settle the cost of local AI generation services. The consumption standard is fixed as twenty coins for a single static avatar generation task and one hundred coins for a single animated GIF production task. All virtual currency balance data and consumption records are only stored in the user’s local device, without cloud synchronization and external backup functions, and the virtual currency system is completely independent of user facial data, and no facial information will be associated with consumption records.
4.2 In-App Purchase Specifications
For iOS device users, Facey supports purchasing virtual coin packs and time-limited subscription services through the official App Store in-app purchase channel. All payment verification, order settlement and transaction record statistics are independently completed by the iOS official system. Facey only receives simple local order validity feedback to activate user corresponding privileges, and will not acquire any payment account information. All purchasing behaviors will not trigger any data collection behavior related to user facial information.
4.3 Refund Related Rules
All virtual coins and subscription privileges purchased by users are applicable only to the local AI generation service inside Facey. Purchased virtual products do not support unilateral refund applications initiated by users under normal use conditions. If users encounter abnormal service faults caused by non-human operation errors, they can contact official support staff to apply for problem solving. All refund review work follows the official specifications of the corresponding device system, and the refund process will not require users to provide facial information, and Facey will not actively collect any facial data.
5. Local Data Management Rules
5.1 Data Storage Range
All types of data generated during the use of Facey, including uploaded original portraits, generated avatar works, local historical generation records and virtual currency consumption logs, are all stored in the exclusive private storage space of the user’s local mobile device. Facey will not preset any external data transmission channel, and all data cannot be automatically uploaded to any external device or platform. The facial features contained in user uploaded photos only exist in temporary local running memory during generation tasks and will not be permanently stored or collected by Facey.
5.2 User Data Control Right
Users have absolute dominant control over all local data related to Facey. Users can delete single generated works, clear specified historical operation records or erase all application cached data at any time through the built-in function of Facey or device system settings. After the user actively deletes the target data, the corresponding content will be permanently cleared from the local device and cannot be recovered. Facey has no authority to manage or back up user local data, and cannot obtain any deleted facial data and related portrait content.
6. Application Maintenance And Disclaimer
6.1 Service Maintenance Notice
The Facey team will carry out regular function optimization, algorithm upgrade and bug repair work for the application to improve the stability and usage experience of local AI generation services. Short-term functional unavailability may occur during the maintenance period. We will try our best to reduce the impact of maintenance on user use, and will not notify users separately for routine minor maintenance. During maintenance and upgrade, all user local data including facial related content will not be accessed or collected by Facey.
6.2 Usage Disclaimer
Facey provides users with local AI avatar generation services on an as-is basis. The Facey team does not make any explicit or implicit guarantee for the aesthetic degree and expected effect of generated avatars. Users shall bear the risks of device system incompatibility and function failure caused by non-official modified application versions by themselves. Within the permitted scope of relevant rules, the Facey team shall not be liable for any indirect losses caused by user’s improper operation, and Facey is exempted from all liabilities related to user facial data leakage, for the reason that we never collect any facial information of users.
7. Supplementary Clauses
7.1 Independent Clause Validity
If any single clause of this User Agreement is deemed invalid or unenforceable due to objective reasons, the invalidity of the single clause will not affect the legal binding force of other remaining clauses. All remaining clauses shall still be implemented and followed by both parties of the agreement. The core clause that Facey does not collect any user facial data shall always remain effective under all objective circumstances.
